Defendant shall be punished by a fine of two million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. On August 29, 2014, the Defendant embezzled the lost resident registration certificates, new cards, our card, and Samsung Card that the victim was in possession of, and returned to, the victim in the vicinity of the Seodaemun-dong, Jongno-gu, Seoul, Jongno-gu, Seoul, the Defendant embezzled his/her idea that he/she had without following necessary procedures, such as acquiring and returning to the victim, etc.
2. Fraud;
A. On August 30, 2014, the Defendant, at around 00:06, presented another person’s new card obtained, as stated in paragraph (1), from the main point of “D” located on the first floor of Yongsan-gu Seoul Metropolitan Government C building, as if he/she were his/her own possession, presented the same card to the victim who was the operator of the said main point, and settled KRW 350,000,000, and acquired economic benefits equivalent to the same amount.
B. On August 30, 2014, around 00:48, the Defendant, at the main point of “F” located in Yongsan-gu Seoul, Yongsan-gu, Seoul, presented another person’s card, as stated in paragraph (1), to the victim who was the operator of the above main point, as if he/she were his/her own possession, and paid 300,000 won, and acquired economic benefits equivalent to the same amount.
C. On August 30, 2014, the Defendant, at around 01:18, presented another person’s new card obtained, as stated in paragraph (1), from the main point of “H” located on the 1st basement of Yongsan-gu Seoul Metropolitan Government Yongsan-gu, Yongsan-gu, to I as if he/she was his/her own possession, and settled 80 million won of the alcohol value and acquired property benefits equivalent to the same amount.
On August 30, 2014, around 02:24, the Defendant: (a) presented another person’s new card obtained from “K” located in the Jung-gu Seoul Jung-guJ as prescribed in paragraph (1) to the victim who was his own employee, and, as such, paid 70,000 won for accommodation expenses to settle the same amount.
3. Violation of the Specialized Credit Financial Business Act;
A. On August 30, 2014, the Defendant lost the victim at the main point of “D” located on the first floor of Yongsan-gu Seoul Metropolitan Government C building around 00:06.
