1. Of the judgment of the first instance court, KRW 15,765,610 against the Plaintiff and its related thereto, from October 3, 2012 to January 15, 2015.
Reasons
1. Basic facts
A. On July 31, 2009, the Plaintiff entered into a building management service contract with the B Steering Committee, which is the managing body, on the building B (hereinafter “the instant building”). The Defendant is a company managing the instant building by leasing Nos. 201, 202, and 204 among the instant building, respectively, and the Defendant is a “C”, “D”, and “E” in subparagraphs 202 and 204, respectively.
B. On November 17, 2010, the Plaintiff applied for a payment order against the Defendant with the purport of seeking payment of KRW 11,743,760, and KRW 15,081,203, which is within the scope of KRW 15,081,50, and KRW 15,081,203, the payment order was issued on November 24, 2010 on the ground that the Defendant did not raise any objection to the unpaid management expenses from January 201 to November 201, 2010.
C. On June 2, 2011, the Plaintiff: (a) reduced part of the unpaid management expenses up to that time with the Defendant to KRW 20,000,000; and (b) paid KRW 15,000,000 from the Defendant; (c) the remainder of the unpaid amount to KRW 5,000,000 was postponed until the 17th of the same month; (d) however, the Defendant did not pay the said KRW 5,00,000.
On September 20, 2012, the Plaintiff filed an application with the Defendant for the payment of the total amount of the unpaid management expenses and late payment charges from February 2, 2011 to September 2012, 201 with the Suwon District Court Decision 2012 tea368, which was the Suwon District Court 201 to the Seoul District Court 201, plus the unpaid management expenses and late payment charges from February 2, 2011 to September 2, 2012, including the unpaid management expenses and late payment charges from June 2011 to December 2011, the unpaid management expenses and late payment charges from 5,84,992, and the late payment damages from October 204 to September 2012, 206, including the unpaid management expenses and late payment charges, and the total amount of KRW 6,288,200, the sum of KRW 31,671,882, the aforementioned Suwon District Court 2010 to the payment order, KRW 1530165.65.
