1. The Plaintiff:
A. Defendant B District Housing Redevelopment and Rearrangement Project Association KRW 497,611,576 and KRW 305,042,519 among them.
Reasons
1. Circumstances leading to the dispute of this case;
A. The status of the parties is an autonomous management organization composed of the occupants in order to manage the Seodaemun-gu Seoul Metropolitan Government apartment (hereinafter referred to as the “instant apartment”) and the Defendant Union is a person who constructed and sold the instant apartment, and the Dongbu Construction Co., Ltd. (hereinafter referred to as the “Dongbu Construction”) is a contractor of the instant apartment that was performed by a contract with the Defendant Association for the new construction of the instant apartment, and the Defendant Seoul Guarantee Insurance was an insurance company that entered into a defect warranty insurance contract with respect to the instant apartment.
B. The conclusion of a contract for work and construction of the unit of construction completed the construction of the instant apartment by being awarded a contract by the Defendant Union, and the Defendant Union obtained a provisional approval from the head of Seodaemun-gu on August 28, 2009 from the head of Seodaemun-gu for the instant apartment, and obtained the approval for use on December 31, 2010.
C. On August 12, 2009, Defendant Seoul Guarantee Insurance Co., Ltd entered into a warranty insurance contract with Defendant Dong Construction and the insured as the head of Seodaemun-gu Seoul Metropolitan Government (hereinafter “instant warranty insurance contract”), and issued a guaranty insurance policy with the following contents.
Since then, the plaintiff, which is an autonomous management organization of the apartment of this case, was constituted, the insured of the above warranty insurance contract was changed to the plaintiff.
