1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On April 11, 2016, the Defendant was awarded a successful bid for C 2926 square meters of land for a factory, D 802 square meters of land for a factory, E 13 square meters of land for a factory, and buildings on the ground thereof.
B. On May 10, 2016, the Defendant sold D factory sites and E factory sites of 802 square meters and 133 square meters to the Ministry of Land, Infrastructure and Transport, among the above real estate acquired through a successful bid on May 10, 2016, and submitted a letter of performance to the Korea Appraisal Board to remove the above obstacles by June 10, 2016, after receiving 17,140,000 won as compensation for removal, relocation, and repair of 26.5 square meters on the ground among the 216 square meters of the D-dong Subdivision factory buildings located over Yangsan-si and E among the buildings on the ground.
C. After the Defendant sold part of the real estate acquired by auction to the Ministry of Land, Infrastructure and Transport, the Defendant offered C land for factory and its ground buildings in the amount of KRW 1.2 billion.
On November 4, 2016, the Plaintiff was introduced from the representative G of the F Licensed Real Estate Agent Office, the Defendant, the total of KRW 2926 square meters of land for C in Gyeyang-si and its ground buildings owned by the Defendant, to KRW 1.2 billion. However, the Plaintiff, including the waste disposal cost, negotiated with the Defendant at KRW 1.15 million to KRW 1.16 million.
On November 16, 2016, G asked G to consult about KRW 1.13 billion.
E. On November 21, 2016, G, which the Defendant’s representative director returned from the U.S. business trip, proposed to the Defendant KRW 1130 million, but the Defendant refused to reduce the price by means of negotiations with other applicants for purchase.
F. After finding the Defendant’s office directly on the same day, the Plaintiff concluded a sales contract with the Defendant’s representative director and paid the down payment of KRW 20 million on the day of the signing of the sales contract by setting the above-mentioned building with the purchase price of KRW 1.145 million, which includes the instant obstacles, as the land site C 2926 square meters and the instant obstacles.
G. On November 29, 2016, the remaining payment date, the Plaintiff paid the remainder KRW 1.125 billion and transferred ownership registration and delivery.
