1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. The Plaintiff was appointed as a local public official on September 1, 1981, and served as B by the Chungcheongbuk-do Office of Education from January 1, 2011 to December 31, 2013.

B. The Defendant: (a) committed the following misconduct to the Plaintiff; (b) the Plaintiff’s misconduct constitutes grounds for disciplinary action under Article 69(1) of the former Local Public Officials Act (amended by Act No. 13292, May 18, 2015; hereinafter the same shall apply); (c) Articles 48, 51, and 55 of the former Local Public Officials Act (amended by Act No. 13292, May 18, 201); and (d) Article 10 of the former Code of Conduct for Public Officials of the Chungcheongbuk-do Office of Education (amended by Act No. 689, Oct. 31, 2014; hereinafter the same shall apply); and (d) the Plaintiff’s receipt of 40,000 won roof from a person related to his/her duties constitutes subject to disciplinary action under Article 69-2 of the former Local Public Officials Act; and (d) thereby, dismissed the Plaintiff from office on the ground that the Plaintiff’s receipt of 40,000 won.

[Grounds for Disciplinary Action]

1. In compiling a budget for purchasing educational robots (hereinafter “robots”) with a view to inducing students’ self-defense, the government ordered the budget officer in charge of the office of education to request the budget without considering the propriety of the budget compilation, such as necessity, price adequacy, etc., at all the business departments, such as the one-way school or each office of education, without considering the appropriateness of the budget compilation. In order to undergo a preliminary review of the budget, the government participated in the selection of the company, such as recommending the Pamplet of a specific company, etc., to the person in charge of the office of education

2. A detailed project for moving to a different religious order on a voluntary basis without any consultation or explanation with regard to the two major schools in 2012 (detailed project - a subsidy for special education demand), the four major schools in 2013 (detailed project - other financial support expenses) and superior officers in 160 million won in 2013.
