1. Each part of the judgment of the court of first instance against the plaintiff A, AB, and A, which is cited below, shall be revoked.

Reasons

1. Basic facts

A. On June 26, 2001, the Defendant: (a) obtained the approval of the business plan under Article 33 of the former Housing Construction Promotion Act (amended by Act No. 6655 of Feb. 4, 2002) and Article 32 of the Enforcement Decree of the same Act (amended by Presidential Decree No. 17816 of Dec. 26, 2002) from the Sinpo City on the trade name of “AG”; (b) obtained the funding from the National Housing Fund; (c) decided to construct 802 households with 14,000 publicly constructed apartment units (hereinafter “instant apartment”), which are publicly constructed rental houses, on the ground of 30,963 square meters of the National Housing Fund; and (d) made a public announcement on November 28, 2001.

B. The Plaintiff Z, C, D, E, E, F, AC, J, K, L,O, T, V, and Y respectively concluded a lease agreement with the Defendant on each apartment set forth in the “rental Housing column” column as set out in the table below the first designation period of the apartment of this case (from August 29, 2003 to September 19, 2003).

Since then, the lease deposit has been gradually increased, and the lease deposit paid by the above plaintiffs under each of the above lease agreements as of the date of the closing of the argument in this case is the amount indicated in the column of "rental deposit."
