Punishment of the crime

Defendant

B is the representative of the “E gas station” in Sejong City, and the defendant A works as the head of the above gas station.

1. Defendant A shall not sell petroleum, such as oil, secondary fuel, bio-fuel, diesel and petroleum intermediate products as fuel for automobiles under Article 2 subparag. 1 of the Automobile Management Act and vehicles and machinery prescribed by Presidential Decree on behalf of the representative of the “E gas station” as a manager in charge of the management of the operation of the gas station, and no petroleum retailer shall sell them as fuel for automobiles under Article 2 subparag. 1 of the Automobile Management Act.

Nevertheless, from October 5, 2015 to March 8, 2016, the Defendant sold 36,556 liters, etc. as fuel for construction machinery, to 130 times in total, to dump drivers of “G” vehicles H (53 tax and south) belonging to “F,” which is an external customer at the aforementioned gas station.

2. Defendant B, the representative of Defendant B’s petroleum selling company, who is the E gas station, caused Defendant B, an employee, to commit an act of violation as above in relation to the Defendant B’s business.
