A defendant shall be punished by imprisonment for one year.

The defendant shall be 132,00 won by fraud to B who is an applicant for compensation, and 180,00 won by fraud to C.

Punishment of the crime

On June 8, 2017, the Defendant was sentenced to three years of suspension of the execution of imprisonment for fraud, etc. in Busan District Court’s Dong Branch Branch, which became final and conclusive on April 13, 2018, and is currently under suspension of execution. On January 11, 2018, the Defendant was sentenced to ten months of imprisonment for the same crime in the same court, and completed the execution of the sentence in the Jinju Prison on October 18, 2018.

On March 23, 2019, the Defendant sent a message to the effect that “The Defendant would send 180,000 won worth KRW 200,000 to the Defendant’s account in the name of the Defendant” to “O,” which is a medium-sized goods transaction in the Internet, by discounting the right of cultural products under the title “O”. The Defendant sent a message to the effect that “the Defendant would send KRW 200,000 on the face of KRW 180,000 to the account in the name of the Defendant.”

However, in fact, the Defendant did not have the right of cultural products at the time, and even if receiving the money from the victims, it was thought that all of them would be consumed due to living expenses, entertainment expenses, etc., so there was no intention or ability to sell the right

The Defendant, as above, deceiving the victim, received KRW 180,00 from the victim to the K Bank account under the name of the Defendant at around 13:34 of the same day from the victim, and the Defendant, from around that time to August 18, 2019, “S” No. 16 in the [Attachment List No. 16] in the annexed Table No. 16 is the clerical error of H.

In 40 times in total, 5,294,00 won was remitted from victims by deceiving 40 victims by the same method.

Around July 30, 2019, the Defendant posted a letter to sell Q game money to the Internet Carbook, and sent it to the victim R who reported and contacted the above letter to the effect that “If you send KRW 100,000 to the Defendant’s account, you will send the game money equivalent to KRW 165,50,000.”
