피고인들은 2013. 6. 17. 03:00경 군산시 D 소재 E 주점 앞 노상에서 술에 취한 상태로 길가에 서 있다가 피해자 F(여, 28세), G(여, 25세), H(여, 28세)의 일행인 I이 쳐다봤다는 이유로 “남자새끼 너 이리 와라 여자들하고 있으니까 가오잡냐”고 하면서 시비를 걸었고, 피고인 A은 “왜 시비를 거느냐”라고 하면서 피해자 F이 따진다는 이유로 화가 나 주먹으로 피해자 F의 얼굴 부위를 2회 때리고, 피해자 F이 바닥에 쓰러지자 발로 피해자 F의 턱 부위를 1회 걷어 차 피해자 F에게 약 1주간의 치료가 필요한 우측안면부 찰과상 등을 가하였고, 계속하여 위와 같이 폭행당하여 쓰러진 F을 피해자 G이 부축하였다는 이유로 피해자 G에게 “너는 어떤 년이냐”라고 하면서 발로 피해자 G의 우측 얼굴 부위를 1회 걷어 차 폭행하고, 피고인 B은 피해자 H이 승용차의 경적기를 울렸다는 이유로 화가 나 피해자 H에게 “걸레같은 년아 왜 빵빵거리냐”라고 하면서 손바닥으로 피해자 H의 가슴 부위를 1회 밀고, 손으로 피해자 H의 멱살을 잡고, 피고인 A은 이에 합세하여 손으로 피해자 H의 왼쪽 손목을 약 5분간 세게 잡는 등 폭행하여 피해자 H에게 약 1주간의 치료가 필요한 우측안면부 찰과상 등의 상해를 가하였다.
