Reasons
Punishment of the crime
The Defendant, as a foreigner of the nationality of Malaysia, conspired to purchase high-priced goods at a sale of valuable goods in the Republic of Korea with a forged credit card from a sale of valuable goods in the territory of the Republic of Korea and to remove them from Malaysia.
The Defendant: (a) carried out goods purchased from the Republic of Korea through the above public offering to Malaysia to receive an amount equivalent to 10% of the value of the goods in return for the purchase of the goods from the Malaysia; (b) around August 25, 2016, the Defendant received 12 credit cards forged from the person under whose name the Malaysia received the instructions of “D” at the Malaysia-based Airport; and (c) entered the Republic of Korea through the Incheon Airport on the same day.
1. On August 25, 2016, the Defendant violated the Fraud and the Specialized Credit Financial Business Act (AD) paid taxi charges of an amount equivalent to 65,000 won in the vicinity of the F Hotel located in Jung-gu Seoul Metropolitan Government, and presented the forged credit card (G) received from the victim H, a taxi engineer, as if the credit card was actually issued with genuinely, and obtained property gains equivalent to 65,000 won by signing on the sales slip, and around 20:46 of the same day, the Defendant paid accommodation charges of an amount equivalent to 80,000 won in the hotel L/C located in 30,000 in Jung-gu Seoul Metropolitan City, and then offered the said credit card to the non-employee of the hotel, the victim, who was the victim, signed the sales slip, and acquired financial profits equivalent to KRW 800,000,000.
Accordingly, the defendant, in collusion with the name-free winners, had the victims enticed twice to acquire the financial benefits equivalent to KRW 865,00, and used the forged credit card.
2. The Defendant who attempted to commit fraud or violated the Specialized Credit Financial Business Act (Attempted Crime) in collusion with the false names, as above, and at around 16:23 August 25, 2016, the mobile phone conviction card equivalent to KRW 1,004 at the Incheon International Airport located at the Jung-gu Airport, Jung-gu, Incheon.
