피고인은 2016. 12. 31. 00:05 경 부산 부산진구 B에 있는 지하철 C 역 내 만남의 광장에서, 술에 취하여 잠을 자는 것을 깨운다는 이유로 D 등 역무원들에게 욕설을 하고 소란을 피우다가 112 신고를 받고 현장에 출동한 E 지구대 소속 경위인 피해자 F, 같은 지구대 소속 경위인 피해자 G에게 “ 야, 이 씹새끼야, 내가 자는데 왜 깨우고 지랄이고, 개새끼야, 씹할 놈 아, 짭새 새끼들 아, 내가 H 처남인데 느그들은 다 죽여 버린다, 모가지 잘라 버린다 ”라고 큰 소리로 욕설을 하여 공연히 피해자들을 모욕하였다.
