1. The defendant, among the two floors underground of the Atel buildings in Gangnam-gu Seoul Metropolitan Government, shall indicate the attached Form 2 Map 1 and 2.
Reasons
1. Facts of recognition;
A. 1) The Plaintiff is a party. The Plaintiff is an officetel A (hereinafter “instant building”) located in Gangnam-gu Seoul Metropolitan Government, an aggregate building.
(2) The Plaintiff is a management body established under the Act on the Ownership and Management of Aggregate Buildings for the management of the instant building. The Plaintiff is responsible for the management of the public part of the instant building. (2) The Defendant is the lessee of the portion (a) in the ship connecting each point of the attached Table 1 drawings Nos. 1, 2, 3, 4, 5, 6, and 1 among the first floor above the instant building.
B. From January 1, 2009 to December 31, 2013, the Defendant leased the leased object of this case from January 1, 2009, to KRW 300 million, monthly rent of KRW 34,00,000 (a separate charge and management fee) and operated a crowdfunding and a plastic bag. The Defendant at auction of the leased object was unable to recover the deposit. In order to continue to operate the New Owners from August 9, 2013 to August 12, 2018, the Defendant concluded a lease agreement again on the premise of KRW 40 million, monthly rent of KRW 40,000 (a separate charge and management fee), KRW 30,00,000,000 (a separate charge). In addition to the leased object of this case, the Defendant occupied the leased object of this case as well as the leased object of this case, each section of the attached Table 25,70,000 square meters and 36,000,000.
C. 1) The Defendant, while first leasing the leased object of this case, entered into an agreement with the Plaintiff on January 5, 2009 as follows (A 3; hereinafter the instant agreement).
2) In order to promote lease and increase the value of the assets of the sectional owners, the Defendant side shall pay the full-time amount of the subsidies for the total management expenses (VAT Map 25th of each month, separate from the user management expenses.
