Punishment of the crime

피고인은 2016. 5. 17. 경 광주시 C에 있는 D 당구장에서, 피해자 E에게 “ 내가 전국 구로 땡 처리 의류 사업을 시작하려고 하는데 물건을 약 400원에 들여오면 1,000원 정도에 팔 수 있어 충분히 사업성이 있다, 사업자금이 부족한 데 돈을 빌려 주면 5부 이자를 주겠다 ”라고 거짓말하였다.

그러나 편취 액 합계가 5,615만 원에 이르는 점, 피고인이 피해자에게 설명한 ‘ 땡 처리 의류 사업’ 은 실제 진행되지 않았고, 피고인은 편취 액을 기존 채무의 변제나 생활비 등으로 대부분 사용한 것으로 보이는 점, 피해 회복이 거의 이루어지지 않았고, 피해 자로부터 용서 받지도 못한 점 등을 고려할 때, 피고인에 대한 엄벌은 불가피하다.
