【Criminal Power】 On August 25, 2015, the Defendant was issued a summary order of KRW 3 million for a violation of the Road Traffic Act (driving) at the Seo-gu District Court’s Branch Branch, etc. on August 25, 2015; on November 19, 2015, the Defendant was sentenced to a fine of KRW 4 million for the same crime, etc.; on June 22, 2017, the same court was sentenced to imprisonment for ten months for the same crime, etc.; on June 22, 2017, the Defendant was released from Daegu Detention House on December 22, 2017 during the execution of the sentence and was sentenced to imprisonment for two or more times for a violation of the Road Traffic Act (driving) after the lapse of the parole period on January 16, 2018.

【Criminal Facts】

1. On June 19, 2018, the Defendant: (a) driven an Ethball vehicle under the influence of alcohol by 0.149% of alcohol level without obtaining a driver’s license in a section of about 500 meters from the roads located in Seo-gu, Daegu to the roads in Daegu-gu, Seo-gu, Seoul, to the road; (b) around 02:06, the Defendant driven an Ethball vehicle under the influence of alcohol level of 0.149%.

2. On June 20, 2018, the Defendant violated the Road Traffic Act (unlicensed driving) and revised “09:36 times” as “09:22 times” without any amendment process, to the extent that the Defendant did not disadvantage the Defendant’s exercise of his/her right to defense.
