1. The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) is entitled to the Plaintiff (Counterclaim Defendant) mark 1, 2, 3, and 4.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
Basic Facts
A. On March 15, 1979, the Plaintiff’s attached network D completed the registration of transfer of ownership with respect to E large 1,104 square meters (hereinafter “Plaintiff’s land”). On September 24, 1994, the Plaintiff completed the registration of transfer of ownership with respect to the above land on November 20, 1980.
B. On April 12, 1985, the Defendant completed the registration of ownership transfer on the ground of sale on April 10, 1985 with respect to the land of the Plaintiff, Seopopo-si, Seopo-si, Seopo-si, Seopo-si, Seopo-si (hereinafter “instant land”).
C. Of the instant land, the Plaintiff owns a 39 square meter on the ground of section 39 square meters on the part of the ship connecting each point of Section 1, 1, 2, 3, 4, 1, and 39 square meters in sequence, among the instant land (hereinafter “instant part”), and occupies the relevant part.
[인정근거] 다툼 없는 사실, 갑 제1, 2호증(가지번호 포함)의 각 기재, 이 법원의 한국국토정보공사에 대한 2017. 9. 11.자 측량감정촉탁결과, 이 법원의 현장검증결과, 변론 전체의 취지 당사자의 주장 원고의 주장 원고 토지와 이 사건 토지 사이에는 돌담이 설치되어 있었는데, 그 돌담은 이 사건 토지 중 별지2 도면 표시 ㅌ, ㅋ, ㅊ, ㅇ, ㅅ, ㅂ, ㅍ의 각 점을 차례로 연결한 부분에 있어서 원고가 원고 토지를 증여받기 2~30년 전부터 이 사건 토지 중 별지2 도면 표시 ㅌ, ㅋ, ㅊ, ㅇ, ㅅ, ㅂ, ㅍ, ㅌ의 각 점을 차례로 연결한 선내 나부분 130㎡(이하 ‘이 사건 나부분’이라 한다)을 점유, 사용하였다.
