A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No person who intrudes into an information and communications network shall intrude into the information and communications network without legitimate access authority or beyond the allowed access authority;
The defendant had been able to obtain sexual satisfaction by impairing the IP camera installed by women using the information and communications network by means of stealing real-time images or visual images in which women's body is exposed or their privacy such as sexual intercourses is taken.
The Defendant confirmed the IP address that can be connected to the IP camera of the victims by automatically searching the IP and reported automatically using the information and communications network by using the IP camera program used by a large number of unspecified persons on the Internet, and tried to enter the data password of the early mination account opened at the time of sale by the victims, such as the IP camera web page and the E, into the data manager’s authority.
A. On April 28, 2017, at around 02:40, the Defendant used a computer in the north-gu Seoul Metropolitan City, North-gu, 103 Dong 902, and the Defendant’s residence, the Defendant: (a) entered the “E” password into the web page (J) in which the victim G used the information and communications network in the HI clothing store located in Jung-gu, Seoul; and (b) invaded into the victim’s IP camera; and (c) intruded into the victim’s IP camera; (d) from around 23:30 on April 21, 2017 to July 14:20, 2017, without legitimate access to the information and communications network (IPC) via the same method.
B. In the manner described in paragraph (a) and in the same manner, the Defendant attempted to intrude the victim’s IP camera (K) with the victim’s name in the North-gu Seoul Metropolitan City, North-gu, 103 Dong 902 at around April 17, 2017, and from around that time until July 14:20, 2017, in total 8,147, such as the Defendant’s list of crimes (2) in the same manner.
