A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 야간건조물침입절도 피고인은 2014. 3. 12. 04:00경 서울 양천구 B아파트에 이르러 열려 있는 1층 출입문으로 들어가 엘리베이터를 타고 12층 공용 복도까지 침입하여 그곳에 놓여 있던 피해자 C 소유인 시가 100만 원 상당의 블랙캣370 자전거 1대의 잠금장치를 미리 준비해간 절단기로 끊고 위 자전거를 끌고 가 절취한 것을 비롯하여, 2012. 8. 초순경부터 2014. 4. 12.경에 이르기까지 별지 범죄일람표 기재와 같이 총 13회에 걸쳐 야간에 타인이 간수하는 건조물에 침입하여 시가 합계 858만 원 상당의 자전거 13대를 절취하였다.

2. Larceny;

A. 나. 피고인은 2014. 2. 16. 15:00경 안양시 만안구 E에 있는 F학원 건물 1층 계단에 세워져 있던 피해자 G 소유인 시가 150만 원 상당의 첼로XC 자전거 1대의 잠금장치를 미리 준비해간 절단기로 끊은 다음 위 자전거를 끌고 가 절취하였다.
