A defendant shall be punished by imprisonment for not more than ten months.

The defendant is a seafarer of the inshore fishing boat B of a wooden fishing boat.

피고인은 2019. 5. 19. 20:00경 전남 신안군 재원도 동방 0.2마일 해상에 정박 중인 B에서, B에 놀러온 C 선장 피해자 D(40세)으로부터 “술을 그만 마시고 자라”라는 말을 듣자 화가 나 갑판에 있던 위험한 물건인 식칼(총 길이 약 30cm, 칼날길이 약 20cm)을 들고 C로 도망가는 피해자 D을 쫓아간 후, 피해자 D이 조타실 안에 들어가 문을 잠그자 피해자 D에게 “너, 내가 죽여버린다”고 소리치고 위 식칼로 조타실 출입문을 1회 찔러 피해자 D을 협박하고, 계속하여 동료 선원인 피해자 E(48세)이 피고인을 제지하였다는 이유로 피해자 E에게 “왜 나만 갖고 지랄이야, 내가 뭘 잘못했는데 씨발”이라고 소리치면서 갑판에 있던 위험한 물건인 식칼(총 길이 약 30cm, 칼날길이 약 20cm)을 피해자 E에게 수회 휘둘러 피해자 E을 협박하였다.
