1. Basic facts

A. The Plaintiff and the Defendant were wholly amended by Act No. 7945 of Oct. 29, 2006 as the former Special Act on Special Measures for the Structural Improvement of Small and Medium Enterprises and the Vitalization of Traditional Markets (amended by Act No. 7235 of Oct. 22, 2004, the Act on Special Measures for the Development of Traditional Markets was amended by Act No. 9887 of Dec. 30, 2009 to develop Traditional Markets and Shopping Districts. As the Act was amended by Act No. 9887 of Dec. 30, 2009, the legal name was repealed by Article 3 of the Addenda; hereinafter referred to as the “former Special Act on Traditional Markets”) and the Act on the Maintenance and Improvement of Urban Areas and Shopping Districts (hereinafter referred to as the “instant building”) to implement the project.

B. 1) The instant association is the head of Gangnam-gu Seoul Metropolitan Government (hereinafter referred to as the “head of Gangnam-gu”).

() From March 9, 2010, the authorization for the implementation of the instant building was issued on January 31, 201, and the instant project was implemented upon authorization for the implementation of the management and disposal plan on August 29, 201, and obtained authorization for the completion of the instant building on August 29, 2013. On November 15, 2013, a resolution was issued to revise the management and disposal plan to alter the size, housing site shares, etc. of each store of the instant building on December 26, 2013, and the notification was issued for the transfer of the instant building on December 26, 2013. On January 15, 2014, the registration for the preservation of ownership was completed in the name of each store of the instant building, and on May 13, 2016, the transfer of the instant building site was publicly notified.
