1. The plaintiff's claim is dismissed.
2. The costs of the lawsuit shall be borne by the Plaintiff, including the costs incurred by participation.
Reasons
1. Details of the disposition;
A. On March 21, 2005, the Plaintiff applied for approval of the establishment of a factory, etc. (1) The Plaintiff is the Defendant’s land listed in the attached Table 1 list (hereinafter “instant land”).
(B) On the land of Pyeongtaek-si and Pyeongtaek-si, the applicant filed an application for approval of factory construction with the date scheduled for completion of construction work around April 2005 and the scheduled date scheduled for completion of construction work on March 2007.
Conditions of Approval for New Establishment of Factories
1.The approval of factory construction may be revoked if:
Where a report on the completion under Article 15 of the Act is not made within four years from the date when three years (two years from the date when permission for or report on the diversion of farmland has been deemed granted) have elapsed from the date of approval for the establishment of a factory without justifiable grounds, or where construction has been suspended for not less than one year after the commencement of a factory without justifiable grounds, after approval for the establishment, etc. of a factory and
9. He shall obtain the building permit under the provisions of Article 8 of the Building Act.
2) On April 15, 2005, the Defendant issued the Industrial Cluster Development and Factory Establishment Act (amended by Act No. 7678 of Aug. 4, 2005) to the Plaintiff on April 15, 2005 (hereinafter “Industrial Cluster Act”).
) Approval of the Plaintiff’s establishment establishment (hereinafter “instant factory establishment approval”) pursuant to Article 13(1) and Article 19(3) of the Enforcement Decree of the same Act.
(3) On June 24, 2005, the Plaintiff completed the manufacturing business registration of the company name “E” with the land of Pyeongtaek-si as the location of the place of business and completed the construction work to create access roads to the land of this case around that time.
B. On June 30, 2008, the Minister of Land, Transport and Maritime Affairs designated a logistics complex on a five-year comprehensive plan for the development of logistics facilities as announced by the Ministry of Land, Transport and Maritime Affairs No. 2008-271.
