피고인은 2014. 11. 16. 16:45경 포항시 남구 서동로에 있는 동빈교 부근 도로를 승용차를 타고 가던 중 같은 방향으로 오토바이를 타고 가던 피해자 B(34세)이 피고인의 승용차 앞쪽 두 개 차로를 걸쳐 오토바이를 운행하여 차량 진행을 방해하였다는 이유로 같은 구에 있는 홍알빌라 앞 도로에서 신호대기 중인 피해자를 오토바이에서 내리게 한 후 오토바이 헬멧을 벗겨 바닥에 던지고 피해자에게 욕설을 하면서 한 손을 들고 때릴 듯이 시늉하다가 피해자의 멱살을 잡아 흔들어 폭행하였다.
