A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[Criminal Power] On June 26, 2018, the Defendant was sentenced to six months of imprisonment for fraud at the Seoul Western District Court, and completed the execution of the sentence on November 28, 2018.

The Defendant of “2018 Highest 7171”, around 13:43 on December 7, 2018, operated by the Victim C in Suwon-si, Suwon-si, Suwon-si, as “DPC bank” by the victim C, and the facts are as follows: (a) although there is no intent or ability to pay the price even if he/she uses the PC or orders food and beverages, he/she would normally pay the price to E, an employee of the PC bank; and (b) the same month.

8. From 23:05 to 23:00, the above PC was used and paid 50,100 won of the price. If the above victim did not pay 50,100 won of the price, thereby obtaining monetary benefits equivalent to the value of the above PC, then he was provided with food, such as balls.

Accordingly, the defendant, by deceiving the victim, received property and acquired property benefits.

The Defendant, “2018 Highest 7423” from around 09:16 to 16:30 on December 9, 2018, in fact, in Suwon-si F and HPC bank operated by Suwon-si, the victim G, even though there is no intent or ability to pay the cost of using the PC, deceiving the victim as if he were to pay the cost of using the PC normally, using the PC for about seven hours, and did not pay KRW 10,800.

Accordingly, the defendant acquired the above 10,800 won property interest.

The Defendant, from around 02:30 on February 23, 2019 to around 02:30 on February 24, 2019, by deceiving the victim by means of inducing the victim to pay the cost of using the PC or food to him/her in a normal manner without intent or ability to pay the cost of using the PC in the operation of the J of Gangwon-si I and II from around 07:30 on February 24, 2019, and by inducing him/her to pay the cost of using the PC, and by failing to pay the cost of 40,600 won, he/she acquired the same amount of financial benefits from the victim, and by using the same method, 3,500 won at the market price and 40,000 won from the World Cup.
