1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The defendant is also the operator and the seller of the five-story underground and the fifteen-story E hotel (hereinafter “instant hotel”) scheduled to be constructed on the ground of Gangwon-gun D.
B. 1) F on July 25, 2015, as between the Defendant and the Defendant, the supply amount of G of the instant hotel is KRW 184,287,250 (including value-added tax; hereinafter the same shall apply) with respect to G of the instant hotel.
(2) On August 1, 2015, the Plaintiff entered into a supply contract with the Defendant to purchase the said supply contract, and paid the down payment of KRW 18,428,725 to the Defendant on the same day. (2) On August 1, 2015, the Plaintiff A entered into a contract for succession to all rights and obligations under the said supply contract.
3) On August 14, 2015, Plaintiff B entered into a supply contract with the Defendant to purchase H & I out of the instant hotel in KRW 186,457,250, respectively (hereinafter collectively referred to as “each supply contract of this case”).
(4) The contents of each supply contract of this case relating to this case are as follows.
The executive officer and the defendant seller (hereinafter referred to as "A") and the representative trust administrator J and the purchaser (hereinafter referred to as "B") are aware that the "A" and "A" enter into a contract for sale management trust, business agreement, and agency business under the Act on Sale of Buildings and the sale of buildings in units in accordance with the trust contract and the Act on Sale of Buildings, and they are aware that the objects of sale in units are sold in accordance with the trust contract and the Act on Sale of Buildings and conclude the supply contract as follows:
