1. All of the plaintiff's claims are dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The establishment process of the instant housing association and the implementation process of the instant apartment construction project, which was conducted by the X housing association and the instant apartment construction project, from around September 30, 1999, the X housing association and the Y foreign press association as the representative W enter into an agreement with the AE corporation, jointly with the X housing association and the AC housing association, from around December 31, 2001, to promote the apartment construction project (hereinafter “instant apartment project”). From around December 31, 2001, the AC housing association, the representative of AB, was organized, and the X housing association and the AC housing association jointly promoted the said apartment project. The X housing association and the AC housing association purchased 18 lots, such as the Seongbuk-gu Seoul Housing Association, with the condition that the AE corporation invested funds to purchase the remaining sites and made profits from the project.

(2) After that, X housing association and AC housing association were incorporated into AG housing association (hereinafter “instant housing association”) on July 3, 2002. On August 17, 2002, the head of Seongbuk-gu, the competent authority, obtained the authorization for change of housing association. On August 17, 2002, the instant housing association and AF corporation were joint project undertakers, and obtained the approval for the housing construction project plan for the instant apartment project from the head of Seongbuk-gu, but the instant apartment project with the said company was not carried out properly due to the failure to smoothly raise funds for the purchase of project sites.

(3) On October 7, 2002, the instant housing association is a joint project agreement (hereinafter “instant joint project agreement”) with the following contents in order to newly construct 339 households of AI apartment units on the Seongbuk-gu Seoul and 52 lots (on the basis of the number of parcels divided thereafter, a total of 55 lots was divided; hereinafter the same shall apply) between the aforementioned three parties.
