All prosecutions against the Defendants are dismissed.

1. Summary of the facts charged

A. Defendant A is a spouse who has completed a marriage report with D on July 01, 2011.

1) Around 22:00 on March 21, 201, the Defendant, who was parked in the alley near the Bupyeong-gu, Incheon, Bupyeong-gu, Incheon, Seo-gu, Incheon, with B and once sexual intercourses with B on the E-car owned by the Defendant. 2) On March 08, 2014, the Defendant, who was unable to know the trade name in front of the Seo-gu, Bupyeong-gu, Incheon, Seo-gu, Incheon, Seo-gu, Incheon, with B and once sexual intercourses.

3) From Apr. 2014 to Jun. 2014, the Defendant met with B and 4 times in Yeonsu-gu Incheon Metropolitan City FF Loans 103 to Jun. 2014, respectively. (4) around July 21, 2014, the Defendant sent the same between B and B around 22:00, the third floor corridor of Yeonsu-gu Incheon Metropolitan City G commercial building.

5) On August 2014, the Defendant was sent to the police of Yeonsu-gu Incheon, Yeonsu-gu, Incheon, Hamba 302 to B and 2 times, respectively. 6) The Defendant was sent to the police of the Republic of Korea on September 03, 2014, with B and once sexual intercourse with B on September 03, 2014.

B. Around August 1, 2014, Defendant B, who became aware that he/she was a spouse of the above A, was sexual intercourse with A and three times respectively at each time and place described in paragraphs (1)(5) and (6).

2. The facts charged in the instant case are crimes falling under Article 241(1) of the Criminal Act and can be discussed only when the spouse's complaint is filed pursuant to Article 241(2) of the Criminal Act. According to the records of the instant case, Defendant A's spouse D may be acknowledged as the fact that the Defendants' complaint against the Defendants was fully revoked on November 11, 2014, which is after the prosecution of the instant case.
