1. The Plaintiff:
A. Defendant B’s KRW 30,360,00 and for this, KRW 5% per annum from May 31, 2018 to September 6, 2019.
Reasons
1. Claim against the defendant B
(a)be as shown in the attachment of the claim;
(b) Articles 208(3)2 and 150(3) and 150(1) of the Civil Procedure Act of the judgment to recommend confession
C. According to Article 2(2) of the Addenda of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019) on statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, statutory interest rates under the main sentence of Article 3(1) are 12% per annum from June 1, 2019, since the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Legal Proceedings, Etc. is 12% per annum from the day after the delivery of the written complaint
2. Claim against Defendant C
A. On July 7, 2016, Defendant C is a licensed real estate agent who registered and operated the office of the E Licensed Real Estate Agent (hereinafter “E Licensed Real Estate Agent”) in Yong-si, Yong-si, and Defendant B is a broker at the instant brokerage office from July 2016 to September 20, 2018. 2) Nonparty C delegated the instant brokerage office with the duties of entering into a lease agreement with the Hudio I (hereinafter “Hudio”).
3) On May 21, 2018, the Plaintiff entered into a provisional contract with the broker of Defendant B as KRW 30 million, KRW 30,000,000 per month of rent, and KRW 12 months of lease. On the same day, around 14:09, Defendant B transferred KRW 2,00,000 to Defendant B with the provisional contract deposit. Defendant B, on May 31, 2018, entered into a lease contract with the lessor, the Plaintiff’s lessee, and the leased object as Hudio (hereinafter “instant lease contract”), and printed out the lease contract with the lessor, the Plaintiff’s lessee, and the lessor’s signature, and then printed out the lease contract to the subcontractor and the lessor’s signature column. Defendant B created and kept in the real estate agent’s seal box, affixed the seal affixed to Defendant C, and delivered it to the Plaintiff.
The plaintiff on the same day shall pay 30 million won a deposit to the defendant B at KRW 30 million.
