Reasons
Punishment of the crime
The Defendant and B, 2020-Ma315, as the family-friendly relationship between the Defendant and B, around April 2018, while working as a brokerage assistant at the D Licensed Real Estate Agent Office located in Yangsan-si, Yangsan-si, the Plaintiff explained the terms and conditions of the lease at a higher amount of deposit than the terms and conditions of the lease requested by the lessor, and the lessee provided the lessee with a forged lease contract under the name of the lessor and the broker, and the lessor intended to deliver the forged lease contract in the name of the lessor and the broker to distribute the difference after paying the difference.
1. On April 17, 2018, the Defendant and B concluded that the victim E would be able to lease the F Building G at the said D Licensed Real Estate Agent Office at the Victim E’s Office on a deposit amount of KRW 33 million.
However, in fact, the Defendant and B were requested by H to lease the F building G at KRW 3 million, monthly rent of KRW 400,000.
The Defendant and B, as seen above, deceiving the victim and transferred one million won to the account under the name of the Defendant on the same day from the victim, and transferred 32 million won to the account under the name of B on April 18, 2018, and received seven million won in total from around that time to February 9, 2019, including the transfer of 32 million won to the account under the name of B on the same day.
Accordingly, the defendant was provided property by deceiving the victims in collusion with B.
2. On April 20, 2018, the Defendant and B, according to the aforementioned public offering, prepared a real estate lease agreement whereby the lessor, B, lessee, E, licensed real estate agent I, deposit3,00,00 won at the office of the above D Licensed Real Estate Agent (hereinafter “D Licensed Real Estate Agent”), and subsequently, the Defendant and B is a private document regarding rights and obligations without authority for the purpose of exercising official seal affixed to, and affixed to, the lessor and I’s name.
