1. The Defendants are to the Plaintiff.

A. Of the land size of 778 square meters in Seongdong-gu, Changwon-si, Changwon-si, the attached Form No. 14, 17, 18, 13, and 14 shall apply.

1. Facts of recognition;

A. The Plaintiff is the owner of 778m2 (hereinafter “instant land”) of Seongdong-gu, Changwon-si, Changwon-si.

B. The Defendants are the successors of F, who owned a 29.75 square meters and a block structure 16.53 square meters of a single-story housing (hereinafter “each of the instant housing”) in Changwon-si, Seowon-si E-si, Sungwon-si E-si.

다. 피고들은 이 사건 토지 중 별지 도면 표시 14, 17, 18, 13, 14의 각 점을 순차 연결한 선내 ㈏부분 32㎡를 이 사건 각 주택의 부지로 점유하고 있다.

2. Determination

가. 청구원인에 대한 판단 위 인정사실에 의하면, 특별한 사정이 없는 한 피고들은 이 사건 토지의 소유자인 원고에게 이 사건 토지 중 위 ㈏부분 32㎡에 있는 이 사건 각 주택 부분을 철거하고, ㈏부분 32㎡ 토지를 인도할 의무가 있다.

B. On July 30, 198, the Defendants asserted that: (a) on July 30, 1988, F purchased each of the instant housing and owned the instant housing without gathering the fact that part of the instant land was invaded; (b) the Defendants had never known that the instant housing was invaded before the instant lawsuit was filed; and (c) the size of the part that the Defendants invaded (32m2m2) out of the total area of the instant land (778m2) was very small; and (c) the Plaintiff’s damage caused by the instant intrusion was insignificant, and thus, the Plaintiff’s claim constitutes an abuse of rights.

However, the above circumstance alleged by the Defendants alone is difficult to view the Plaintiff’s request for removal and delivery of this case as abuse of rights. Therefore, the Defendants’ assertion is without merit.

C. In conclusion, the Defendants are indicated in the attached Form 14, 17, 18, 13, and 14 of the land of this case among the Plaintiff.
