1. The Defendant shall pay to the Plaintiff KRW 55,782,594 as well as KRW 51,114,520 as to the Plaintiff. From February 18, 2015 to March 3, 2015.
Reasons
1. On September 4, 2014, the Plaintiff entered into a contract for facility leasing (hereinafter “instant lease contract”) with the Defendant on the basis of the lease term of 36 months, monthly rent of 1,759,100 won, and annual interest rate of 24% (hereinafter “instant lease contract”). On February 3, 2015, the Defendant continued to pay the rent by February 10, 2015, and issued a notice to the Defendant that the instant lease contract will be terminated without any separate notice without delay until February 10, 2015; the Defendant’s delivery of the said notice to the Defendant around that time; the Defendant did not pay the leased fee of 36 months, monthly rent of 1,759,100 won; and the Defendant’s settlement of the overdue interest of 30,7546,757,7546,757,7546,757, and 4757,57,205.
According to the above facts, the defendant is obligated to pay to the plaintiff 5,782,594 won (excluding the above amount under the lease agreement, there is no ground for claiming the above amount) remaining 55,782,594 won excluding the expenses for the payment due to the settlement as of February 17, 2015, and 51,114,520 won remaining excluding the expenses for delay due to the lease agreement, after the date the plaintiff seeks reimbursement, 24% per annum interest rate per annum from February 18, 2015, which is the following day of the above basic date until March 3, 2015, as the plaintiff seeks from February 18, 2015, the delivery date of the copy of the complaint of this case, and 24% per annum interest rate per annum from the next day to May 19, 2015, which is 20% interest rate per annum, and damages for delay calculated by 20% per annum from the next day to the day of full payment.
