Criminal facts
1. Defendant B and A’s occupational embezzlement served as the principal of the N Information High School under the Victim M (hereinafter “M”) from March 1, 2003 to February 1, 2010. Defendant A served as the head of the administrative office from April 1, 1991 to February 201. The Defendants conspired to arbitrarily embezzled the amount exceeding the amount of the victim’s new students’ registration fees, school tuition fees, school sports support fees, student enrollment fees, school meal expenses, and after-school tuition fees, and committed the following crimes.
Occupational Embezzlement of New Students
(1) On February 16, 2005, the Defendants withdrawn 72,547,800 won from the passbook of new students in 2005 to Q, who is the N Information High School teacher in the N Information High School, and ordered the Defendant A to pay it to Q, who is the N Information High School teacher in the above passbook. The Defendant A, upon receiving the above order, withdrawn 12,547,800 won from the money in cash and the remainder 60 million won from the 100,000 won check to Q, paid to Q, and embezzled it for the previous students’ deposit arbitrarily used by the Defendant B.

On February 15, 2006, the Defendants instructed Defendant A to sell 64,935,900 won in cash from the passbook for the registration of new students of 2006 to the administrative office of the Ninformation High School, and the Defendant A, upon receipt of such instruction, withdrawn 64,935,900 won from the above passbook in cash from the above passbook and delivered it to Defendant B, and Defendant B embezzled the said money by using the above money arbitrarily used for the purpose of paying the deposits for students who had been arbitrarily used by Defendant B to the existing bank.
Fidelity. The Defendants, at the NInformation High School administrative office on February 14, 2007, withdrawn 25 million won from the head of the Tong for New Students in 2007 (Agricultural T) to the administrative office employees of the N Information High School and withdrawn 25 million won from the head of the Tong for New Students in 2007.
