The defendant's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal is that the Defendant had no intention to escape since he/she left the site on the ground that he/she was unable to recognize the fact of the accident, which was beyond the victim’s error at the time of appeal.
Nevertheless, the judgment of the court below which found the defendant guilty of the facts charged of this case is erroneous.
2. Determination:
A. The following circumstances revealed by the evidence duly adopted and investigated by the court below, i.e., ① The victim, from the investigative agency to the court of the court of the court below, "the defendant's vehicle was so obvious that the defendant's vehicle was crypted with the rab, and the defendant's vehicle in the signal atmosphere was found, so the defendant's crypted with the inside."
“Along with the consistent statement to the effect that the Defendant consistently made a statement, “The Defendant was aware that his own vehicle and the victim suffered from each other, and, according to CCTV images, the Defendant lost balance from the Defendant’s vehicle close to the victim’s vehicle at a very close distance. In light of the fact that the Defendant, who acquired a driver’s license around 190, did not see the victim’s misperion which goes beyond the Defendant’s vehicle at a close point to the extent that the Defendant faces with the Defendant’s vehicle in U-turn in light of the empirical rule, the Defendant was sufficiently aware of the possibility of having suffered from the injury, on the ground that there was no direct conflict between the victim’s vehicle and the victim, even though he had sufficiently known of the possibility of suffering from the injury, and instead left the scene of the accident without taking relief measures, etc. against the victim, it can be sufficiently recognized that there was an intentional negligence on the part of the Defendant.
B. Meanwhile, the Defendant’s process of preparing a written statement on November 7, 2017, which contains contents unfavorable to himself/herself, is unlawful, and thus, can be deemed as evidence of guilt.
