A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a foreigner of Morocco nationality who entered Korea on August 2, 2018.

1. No person who violates the Chemicals Control Act shall take in or inhale hallucinogenic substances which cause interesting hallucination or anesthesia, or possess them for this purpose;

Nevertheless, on September 8, 2018, between 22:00 and 22:30, the Defendant inhaled, at the Defendant’s residence located in a unsound area of Yongsan-gu Seoul Metropolitan Government or lower, the Defendant, in a manner of hostilely and hiding the nose, which is a hallucinogenic substance containing Toluene, etc., into the suspension.

2. Violation of the Railroad Safety Act and violation of the Chemicals Control Act between 07:25 and 07:40 on September 9, 2018, the Defendant entered and carried on the Drailroad platform located in Yongsan-gu Seoul, Yongsan-gu for the purpose of melting by 500 meters of living bottles, and attempted to board Busan KTX trains without permission, but the Defendant was discovered to the service personnel, moving the train to the rest of the platform No. 8 located outside of the train within the guest room and parked within the guest platform No. 8, and then returned to the victim ETX train which was parked outside of the train and stopped on the opposite platform (47 years of age) and the victim F (18 years of age) without permission, and continued to open the part of the victim's 1 to the 8th platform and walk up the victim's 14th platform without permission.

Accordingly, for the purpose of inhaleing, the defendant holds a halluer, which is a hallucinogenic substance, and uses violence to the victims who are railroad workers, thereby protecting the safety and maintaining order in the railroad.
