1. The part against the Defendants in the judgment of the first instance, including the selective claims added in the trial, is as follows.
Reasons
1. In the first instance court, the Plaintiff claimed for the payment of the passive damages (actual income), active damages (the cost of after-the-counter therapy and the past and future nursing expenses) and consolation money against the Defendants. The court of first instance partly accepted the claim for active damages and consolation money and dismissed the claim for passive damages.
The Plaintiff and the Defendants appealed against this, but the Plaintiff waived the claim for passive damages in the purport of appeal as of April 1, 2014 and the application for change of the cause of appeal as of December 9, 2014. Thus, the subject of judgment in this Court is limited to the claim for positive damages and consolation money.
2. The facts of recognition are as follows: Defendant Daeb Construction Co., Ltd. (hereinafter “Defendant Daeb Construction”) contracted the part of civil engineering works among the construction works of Daeban District C Apartment (hereinafter “instant construction”) to Defendant Daeban Co., Ltd. (hereinafter “Defendant Daeban”).
Defendant Daean Construction installed a pents around the boundary line of the instant construction site, and the said pents installed inside the boundary line, obstructing the construction. Defendant Daean C&C concluded a mid-term lease agreement with B, and proceeded with the removal of the said pents.
