A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
No person shall photograph the body of a person who may cause a sexual humiliation or sense of shame, against the will of the person to be taken, by using a camera or other similar mechanism.
그럼에도 불구하고 피고인은 2019. 9. 6. 08:19경 수원시 팔달구 B 소재 C역 1호선 상행선 승강장으로 올라가는 에스컬레이터에서, 원피스를 입은 불상의 여성 피해자 뒤에 선 다음 피고인의 갤럭시S7엣지 휴대폰의 카메라 기능을 켠 후 한쪽 무릎을 굽혀 그 위에 위 휴대폰을 올려놓아 피해자의 원피스 치마 안쪽을 동영상 촬영한 것을 비롯하여 2019. 7. 23. 21:26경부터 2019. 9. 6. 08:19경까지 별지 범죄일람표 기재와 같이 4회에 걸쳐 위 휴대폰을 이용하여 성적 욕망 또는 수치심을 유발할 수 있는 불상의 여성 피해자들의 다리 부위 등 신체 부위를 그 의사에 반하여 몰래 촬영하였다.
