피고인은 2013. 8. 7. 03:25경 서울시 강북구 C에 있는 D 운영의 E식당에서, 영업을 방해한다는 신고를 받고 출동한 경사 F, 순경 G에 의해 현행범으로 체포되었고, 같은 날 03:40경 서울시 강북구 H에 있는 I지구대에서, 일행인 J이 위 D에게 욕설하여 모욕죄로 현행범으로 체포된 후 확인서에 서명ㆍ날인 하려는 것을 막자, 순경 K이 피고인을 제지하였다는 이유로, 위 K에게 ″씹새끼야, 맞장까자, 개새끼, 씹새끼, 한 대 때려버릴라, 내가 너한테 침을 못뱉을 것 같냐″ 라고 욕설하면서 손을 들어 위 K을 때리려고 시늉하고, 위 K의 얼굴에 침을 뱉는 등 폭행하여 피해자 K의 범죄진압 및 범죄수사에 관한 정당한 직무집행을 방해하였다.
