1. Of the judgment of the court of first instance, the part of the judgment against the Defendants exceeding the amount ordered to be paid following, is revoked.

1. Basic facts

A. The Plaintiff is a special corporation that is established under the Industrial Accident Compensation Insurance Act (hereinafter “Industrial Accident Insurance Act”) and is entrusted by the Minister of Employment and Labor with the industrial accident compensation insurance business.

The Net Military Forestry Cooperatives is an industrial accident compensation insurance policyholder under the Industrial Accident Compensation Insurance Act, and C, D, E, F, and G (hereinafter referred to as “victims”, if they are collectively referred to), while entering into a labor contract with the respective net military forestry cooperatives, the following:

나. 피고 A는 2012. 9. 1. 09:35경 H 아반떼 승용차(이하 ‘이 사건 자동차’라고 한다)를 운전하여 전북 순창군 순창읍 백산리에 있는 24번 국도(편도 2차로)의 2차로를 금과면 쪽에서 순창읍 쪽으로 시속 약 142km로 진행하던 중 위 도로의 길가장자리구역에서 태풍피해로 넘어진 가로수를 복구하는 작업을 하고 있던 인부들을 발견하고 1차로로 차로를 변경하면서 중앙분리대를 들이받은 후 오른쪽으로 튕겨나가면서 약 41m를 미끄러져 방호울타리(가드레일)를 들이받아 방호울타리 밖에서 지주목 정비 작업을 하고 있던 F, G을 충격하고, 계속하여 길가장자리구역으로 약 45m를 미끄러지면서 길가장자리구역에서 지시봉을 들고 차량을 향해 수신호를 하고 있던 D, 작업을 하고 있던 C, E을 차례로 충격하여, F로 하여금 두피 타박상 등의 상해를, G으로 하여금 경추 염좌 등의 상해를 각 입게 하고, D으로 하여금 머리 부위 함몰 등 다발성 외상으로 인하여 사망하게 하고, C로 하여금 오른쪽 다리 절단 등 다발성 외상으로 인하여 사망하게 하고, E로 하여금 우 경골 분절골절 등의 상해를 입게 하였다
