Reasons
Punishment of the crime
1. Defendant A
A. On June 5, 2016, the Defendant, without a driver’s license, driven a f car at a section of about 150km from the front side of the E’s house located in Ansan-si D around 06:48 on June 5, 2016 to the Young-dong Highway in the west-gun of the Gangwon-do, Suwon-gun, Jin-si, the extension of which is 0.086% of alcohol level without a driver’s license.
B. The Defendant, while driving as above, was at a point 148 K K in the direction of the Young-dong Highway, which is located in the front direction of the said Gangwon-do Highway.
In order to conceal the fact of driving without a license, the Defendant asked B to “Ialalk to drive the vehicle during the period of suspension of the execution of the internal house, Ialk to request B, who was accompanied by the said vehicle, to “Ialalk to drive the vehicle during the period of suspension of the execution of the internal house, Ialk to the police so that the Defendant could make the person make the statement so.”
B around 08:48 on the same day, at the above rest area, the person was to drive the said car, and to the first and one other, the person was to drive the said car, and such written statement was to be prepared and submitted to the police officers.
In this respect, the defendant instigated B to escape from committing a crime.
2. Defendant B, at the time, at the place specified in Article 2-2(b), and upon being aware that the above A driven the same as that stated in Article 2-2(a) without a driver’s license, the driver stated that the police officer himself was the driver, and submitted a written statement with the same content.
Accordingly, the defendant has escaped the above A who committed a crime corresponding to a fine or heavier punishment.
