A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On May 15, 2014, the Defendant was sentenced to imprisonment for 8 months and 2 years of suspension of execution on January 15, 2015 by the Seoul Eastern District Court for violating the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection, etc., and the said judgment became final and conclusive on January 15, 2015.

【Criminal Facts】

1. Interference with business;

A. On July 15, 2014, at around 10:05, the Defendant: (a) called the “Cpos branch office” office (F) working for the victim D in the south-gu E at a non-place on a port; and (b) demanded the victim to prepare money to get the victim to cover the money to be covered; and (c) even though the victim clearly expressed his/her intention of refusal, the Defendant obstructed the operation of the said office by repeatedly speaking to the said office from August 17, 2014, as described in the attached Table 1, until August 17, 2014, even though the victim explicitly expressed his/her intention of refusal.

B. From around 10:30 on July 19, 2014 to 16:30 on the same day, the Defendant continued to demand a large number of unspecified customers within the “G” operated by the victim H in the south-gu, Nam-gu, to continue to engage in “a request for the lending of mobile phones,” thereby repeatedly engaging in an act that may discomfore the customers, and the victim demanded the suspension of such act, thereby obstructing the victim’s restaurant management by avoiding disturbance.

2. At around 18:00 on September 6, 2014, the Defendant was subject to questioning by K of the circumstances leading up to the police box of the Korea Coast Guard, who called to the scene after receiving a report that “a male who continues to threaten by mobile phones and is bullying within a neighborhood park located in the Dongdong-gu, South-gu, Chungcheongnam-gu, Dongdong-gu.”

The defendant is a police officer who was in charge of the above K's 13:38 on the same day to report his refusal to leave.
