1. Of the land size of 313 square meters in Gwangju Mine-gu, the Defendant indicated in the attached Form 11, 5, 6, 7, 8, 14, 13, 12, and 11, respectively.
Reasons
1. Facts of recognition;
A. On August 29, 1973, the registration of ownership transfer was completed on the ground of “sale on June 7, 1973” in the name of the Plaintiff’s mother-in net with respect to the area of 182 square meters (the size was corrected to 200 square meters on March 17, 2015, based on the arrangement of cadastral records due to the external separation; hereinafter “D land”). (However, the time of the registration of ownership transfer was completed on August 29, 1973 on the ground of “sale on June 7, 1973.”
Meanwhile, the Plaintiff filed a lawsuit against F to the Gwangju District Court for the cancellation of the registration of ownership transfer of D land. Accordingly, the registration of prior notice was completed on January 30, 1975. On February 27, 1981, the registration of ownership transfer was completed on the ground of “the donation on December 31, 1973,” and the registration of prior notice was cancelled on December 9, 1981.
B. Around December 26, 1965, the ownership transfer registration was completed in the name of the Defendant on February 26, 1965 with respect to the land, the land category of which was changed to a site on January 10, 2012, and the land category was changed to a site on March 17, 2015, and the area was changed to a 313 square meters on March 17, 201 through the adjustment of the official cadastral record on March 17, 2015, which was finally corrected to a 403 square meters.
C. On January 20, 1967, the Plaintiff: (a) donated the Plaintiff’s 1st five hundred and twenty-six square meters of land (hereinafter “I land”) and its ground-based housing, which had been drinking between D land and D land and D, and (b) thereafter, was living together with the Plaintiff’s mother E-net and the Plaintiff’s mother’s mother, and (c) died on May 12, 1967.
On the other hand, the registration of ownership transfer has been completed in the name of the network E with respect to the I land, but the time of the registration of ownership transfer is accurate in the record.
