1. The Defendant shall recover the true name on January 11, 1973 with respect to the portion of 108/281 out of B 2,288 square meters prior to the time of strike to the Plaintiff.
Reasons
1. Basic facts
A. On January 11, 1973, the Plaintiff paid to the Defendant securities issued under the former Act on Special Measures for the Disposal of Requisitioned Property (amended by Act No. 4144 of Dec. 21, 1989; hereinafter “former Requisitioned Property Act”) with respect to B 2,288 square meters (hereinafter “instant land”) prior to the period of Pakistan owned by the Defendant on January 11, 1973, and purchased KRW 173,000.
B. ① The issuance register (Evidence A) of the notice of the notice of the payment of compensation for requisition prepared at the time of the issuance of a sales contract (written notice of the notice of the notice of the notice of the payment of compensation for requisition: “A and requisitioned subject matter in Seodaemun: 173,00 won: the amount paid: the week B (1,124: 692 square meters: 173,000 won: the transfer date: January 11, 73: the service classification (date of payment): January 11, 73: 73.” The phrase “receiving the notice of the payment of compensation for requisition was returned, and the defendant received the above notice directly to the Choung Bank,” and the Defendant’s seal is affixed on the statement of the payment of compensation for requisition securities (purchase price and compensation for requisition: 20 won: 1,124 cadastral records, 600 won and amount of compensation for requisition, 200 won and amount of compensation for requisition, 300 won and amount of compensation for requisition, 20050 won and 300 won.
C. According to the land cadastre, B B B 1,124 (hereinafter “B 1,124”) was already partitioned on March 8, 1971 into the instant land (692 square meters) and E 432 square meters, but was not subdivided into a registration injury at the time of around 1973.
According to the above circumstances, the Plaintiff completed the registration of ownership transfer on January 11, 1973 with respect to 692/1,124 shares of the land before subdivision on February 14, 1973.
E. After that, on December 6, 2004, the area on the registry of the instant land was corrected to 692 square meters (2,288 square meters).
