A, on May 2014, dispatched to E (hereinafter referred to as “E”) employees of Company B, and designed the FF Motor Vehicle Development Project (hereinafter referred to as “F Project”) of the new model of the motor vehicle model FF (hereinafter referred to as “F Project”) that is a company in China. Defendant B is a corporation with the purpose of the motor vehicle parts engineering business, etc.

1. On March 16, 2015, the Defendant, at the E office located in Ansan-gu, Manan-gu, Sinyang-si, and the police officers belonging to the Seoul Regional Police Agency (hereinafter “victim”) executed a search and seizure warrant on the E office in order to secure evidentiary materials, such as the victim Hyundai Motor Co., Ltd. (hereinafter “victim”)’s business secrets. Defendant deleted F/H/REA’s design data file on the file server in order to be used by H using a computer located in the B representative, upon receiving the direction of H, for use in preparing a design drawing for the external part design of F.

Accordingly, the defendant destroyed evidence on the criminal case of others.

2. 피고인 주식회사 B 피고인은 2014. 2. 경부터 같은 해 10. 경까지 안양시 만안구 G에 있는 E 사무실에서, 피고인의 대표자인 H, 직원인 I, J이 피고인의 업무에 관하여 부정한 이익을 얻거나 피해 회사에 손해를 가할 목적으로 중국에서 사용될 것임을 알면서 H이 피해 회사의 영업 비밀인 K9 자동차의 리어 범퍼 설계도면 『X86591 _3T000 COVER-RR_BPR _UNDER FAL 101101-LEB 01.CATDrawing』 파일 등 범죄 일람표 기재와 같이 73건을 E의 협력업체가 사용하는 ‘Guest’ 파일 서버에 업 로드하였고, I, J이 위 파일 서버에서 피해 회사의 리어 범퍼 설계 도면 등을 다운로드 하여 F의 범퍼류 설계 도면을 작성하는데 사용하는 등 위반행위를 하였다.
