The prosecutor's appeal is dismissed.
Reasons
1. According to the statement of the victim F and G, it is recognized that the defendant inflicted an injury in need of medical treatment for about six weeks by making the victim’s face, etc. several times and pushing the victim over at the time of this case due to beer diseases, which are dangerous objects at the time of this case.
2. Determination
A. On October 23, 2012, the Defendant: (a) around 23:30 on October 23, 2012, the Defendant: (b) while drinking alcohol at E main points located in Heung-gu, Chungcheongnam-gu; (c) on the ground that the Plaintiff F (the age of 44) went to the said main points, and the Defendant went to the ground by pushing the Victim’s face on the ground that he fell to the said main points; and (d) on the ground that he was a dangerous object for the Defendant to go against the Defendant, the Defendant was able to go to the ground by pushing the Victim on the ground that he prevented the Defendant from going to G.
As a result, the Defendant, while carrying dangerous things as above, boomed the victim or pushed the victim, thereby causing about six weeks of treatment to the victim.
B. The judgment of the court below held that the court below stated to the effect that the following circumstances, i.e., (i) the E main points, (ii) the E main points, presented witness in the court of the court below to the effect that “the Defendant, the victim, and the G were satisfed within the house, and the Defendant was satisfing two victims due to drinking, but at the time, there was no time the Defendant was satisfing with the victim due to becick, and the Defendant was not found later within the main points, and the police did not immediately go to the main point, but there was no empty disease within the main points; (iii) in the court of the court of the court of the court of the court below, I stated to the effect that “the victim would go beyond the main point of the report block near E main points, so far as the police officer, who was a police officer dispatched to the scene, was dispatched to the scene, and there was no food.”
At the time, the statement was not made from G to beer and disease, and it was harsh.
