The judgment of the court below is reversed.

Defendant shall be punished by imprisonment without prison labor for six months.

However, for a period of two years from the date this judgment becomes final and conclusive.

1. Summary of grounds for appeal;

가. 사실오인 내지 법리오해 피고인은 이 사건 사고 당시 반대차선에서 차량이 오는지를 확인하고, 방향지시등을 켜고 좌회전을 하였으므로 좌회전하려는 차량이 갖추어야 할 주의의무를 다하였을 뿐만 아니라, 사이드미러를 통하여 후방에서 차량이 오는지도 확인한 후 좌회전을 하였지만, 피해자가 피고인이 켠 방향지시등을 보지 못하고 비정상적으로 중앙선을 넘어 빠른 속도로 추월한 과실로 인하여 이 사건 사고가 발생하였던 것이므로, 피고인에게는 주의의무를 위반한 과실이 없다.

B. The lower court’s sentence of unreasonable sentencing (six months of imprisonment without labor) is too unreasonable.

2. Determination

A. 1) A driver of a vehicle is bound to comply with traffic regulations, but is not obliged to take measures for preventing accidents as long as the latter vehicle does not drive the vehicle in such a way as to give a direct obstacle to traffic of the latter vehicle in light of ordinary standards. Therefore, even if the left-hand turn turn is not operated in such a manner as to give a direct obstacle to traffic of the latter vehicle, if the turn-hand turn-hand turn-hand turn-hand turn-hand turn-hand or left-hand turn-hand in the prohibited zone, it cannot be said that there is a direct causal relationship between the act of left-hand turn-hand or the occurrence of the accident (see, e.g., Supreme Court Decision 95Do1200, May 28, 1996). Accordingly, if the traffic of the latter vehicle was directly hindered, the causal relationship can be acknowledged between the act of left-hand turn-hand turn in the prohibited zone and the occurrence of the accident.2) According to the evidence duly adopted and investigated by the court below, the following circumstances can be acknowledged.

① Skidmarks discovered at the center line at the site of the accident in this case shall be the Oba of this case.
