1. The Defendant: (a) KRW 275,818,012 to the Plaintiff; and (b) KRW 5% per annum from June 24, 2014 to December 9, 2015 to the Plaintiff.
Reasons
1. Basic facts
A. 1) The Plaintiff entered into a subcontract with the East Construction Industry Co., Ltd. (hereinafter “Dong Construction”).
A) On June 17, 2011, a joint contractor was organized and contracted for a new construction project in Kimpo-si from Kimpo-si, Kimpo-si. Around June 17, 201, the Plaintiff and Dongpo-si were the Plaintiff’s share of 60% and 40%. 2) The Plaintiff and Dong sub-construction subcontracted the part of reinforced concrete construction (hereinafter “instant construction”) among the said new construction works to Lee Ho-dam Construction Co., Ltd. (hereinafter “this case’s construction”). On April 2012, this case’s construction was conducted directly by cancelling a subcontract with Leepo-si and requesting it to D.
3) From that point of view, the Plaintiff and East Construction demanded D to enter into a subcontract on September 2012, 2012, because it is difficult for them to directly carry out the instant construction due to the default on construction in Eastern Construction, and D entered the Defendant Company. 4) The Plaintiff and East Construction entered the Defendant Company on September 20, 2012, but the date of preparation of the subcontract agreement between the Plaintiff and East Construction and the Defendant on August 20, 2012 is retroactively stated.
The Defendant entered into a subcontract on the instant construction project (hereinafter “instant subcontract”) with the Defendant, and thereafter, the Defendant continued to carry out the instant construction project from that time.
B. The roof structure of C in the event of collapse accidents was originally a steel structure, and the design of reinforced concrete structure was modified around June 7, 2012 to reduce air, but it was the remainder of the roof relocation construction work, which was already installed at a height of five stories and was installed at a height of five stories for work board according to the assembly plan before the design modification was completed until October 2012.
