1. 이 사건 공소사실 피고인은 2016. 5. 27. 20:03 경 창원시 마산 회원구 B, 103동 605호 피고인의 주거지에서, 피해자 C을 포함하여 총 8명이 대화 중인 인터넷 세이 클럽 방 제목 'D' 채팅 창에 피고인의 모 E 명의 아이디 'F '으로 접속하여 자기 뜻대로 친구 교제가 안된다는 이유로 피해자의 닉네임 'G '를 지칭하면서 “G 시바 년 아 너 트로트가수 그 시발년 이지 개시 잘 호로 시 벨 좃 년 아 ”라고 경멸적 표현을 게시하여 공연히 피해자를 모욕하였다.

2. The facts charged in the instant case are the crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when a victim files a complaint pursuant to Article 312(1) of the Criminal Act.

According to the records, the victim C may recognize the fact of revoking the complaint against the defendant on September 7, 2016, which was after the public prosecution of this case was instituted. Thus, the public prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
