A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. When the Defendant came to know that he was able to receive considerable money when selling a mobile phone lost by another person to a stolen business operator who has placed an advertisement on the Internet trading site of used goods, the Defendant was willing to receive money by communicating the mobile phone with the stolen business operator as if he sold the mobile phone, and by threatening him with a deadly weapon.

On February 1, 2013, at around 00:20 on the Internet, the Defendant made phone calls to the nameless stolen business operator who became aware of through the Internet, and prepared for be used for committing the crime, such as beer-car (the total length of 22cc and 10cc in length) and mountain bags, etc., and prepared in advance the beer-car (the total length of 22cc and 10cc in length), and then prepared for robbery at around 01:00 on the same day, around 01:0 on the same day, the Defendant waited for the above stolen business operator at one exit in the Dobongcheon-gu, Seoul Special Metropolitan City.

2. At around 01:00 on February 1, 2013, the Defendant: (a) discovered the victim C who had a telephone conversation near the Geumcheon Station; (b) discovered about about 50 meters of the victim’s market value; and (c) cut off the victim’s smartphone 4S, one of which is equivalent to KRW 1 million in the market value owned by the victim, and stolen it by means of escape.

3. Any person who violates the Protection of Military Bases and Installations Act shall obtain permission from the head of a competent unit in advance for access to military bases;

On January 10, 2013, around 01:20 on January 10, 2013, the Defendant entered an international peace support group beyond a fenced by the head mission, which is a military base located in Gyeyang-gu, Incheon, Gyeyang-gu, Incheon.

Accordingly, the defendant entered military bases without permission from the commander of the jurisdictional unit.

4. At night, the Defendant entered an international peace support group in the same time and place as in the preceding paragraph, as in the preceding paragraph, and around 01:30 on the same day, he intrudes into the above-mentioned living room by taking advantage of the gaps where the victims were locked before the 22th Agrasium located in the international peace support group.
