1. 피고인 A, B의 공동 범행 피고인들은 중국 내 불 상의 보이스 피 싱 범죄조직과 함께 국내의 피해자들에게 전화하여 금융기관 직원을 사칭해 ‘ 저금리 대출을 받기 위해서는 기존 대출을 상환해야 한다’ 거나, 수사기관 직원을 사칭해 ‘ 계좌가 범죄에 이용되었으니 안전한 계좌로 돈을 옮기고 지시에 따르라’ 는 등의 거짓말로 피해자들을 속여 금원을 편취하는 범행을 하기로 마음먹고, 팀장인 성명 불상자( 위 챗 대화명 ‘G’) 는 위 범죄조직의 조직원으로서 범행에 사용할 계좌 모집 및 전달 방법 등을 지시하는 역할을 담당하고, 피고인들은 위 범죄조직의 조직원으로서 인터넷 네이버 카페 등에 대출을 해 주겠다는 등의 광고를 게시하여 이를 보고 연락한 사람들에게 ‘ 체크카드를 양도해 주면 그 대가로 50만 원 내지 200만 원의 돈을 주겠다’ 고 말하여 체크카드를 양수 받은 후 이를 위 범죄조직에 전달하여 보이스 피 싱 범행에 사용하도록 하는 역할을 담당하고 편취 금원의 3~4 %를 분배 받기로 순차 공모하였다.

A. In accordance with the above conspiracys as seen above, the employee of the singishing Ting Ting Ting Ting Ting Ting Ting Ting Ting Ting Ting Ting Ting Ting Tings misrepresenting the victim H’s new capital at a place where it is unknown on October 25, 2016, and phone calls for the payment of the existing loan amounting to five million won of the repayment of the loan to the account directed, and five million won of the deposit necessary for the application for the loan. It is so false that it receives five million won from the damaged person’s new bank account (J) in the name of I on the same day, five million won of the total from the new bank account (K) in the name of Defendant B to November 10, 2016, and at that time, from that point to that point, one million won of the loan amount was transferred to the new bank account in the name of Defendant B, as shown in the attached Table 1 (1) by November 1, 2016.
