The defendant shall be innocent.

1. The Defendant is a person who is engaged in driving a wide-area bus of Category B CD belonging to the instant charges.

On November 30, 2017, at around 22:50, the Defendant proceeded at a speed of about 57 km each hour according to the speed of 57 km of the central bus-only bus-only road in front of the F Bank located in Eunpyeong-gu Seoul Metropolitan Government E, from non-wide private street outflow to the Seoul Innovationm intersection.

At the time, it is night and where the view can be restricted due to the location of the exclusive bus lanes and stops at that time. Therefore, a person engaged in driving service of a bus has a duty of care to safely operate the brakes and steering gear by reducing speed in the vicinity of the bus stops and properly operating the brakes and steering gear in a correct manner.

Nevertheless, the Defendant neglected this and found the Victim G (44) who crosses the road from the right side of the Defendant’s vehicle to the left side, but passed the road on the left side, and did not prevent an accident by accelerating immediately and by negligence, the Defendant was the victim as the front part of the bus driven by the Defendant.

After all, the Defendant caused the death of the victim at the I Hospital located in H in Jung-gu Seoul Metropolitan Government on December 1, 2017 due to such occupational negligence.

2. The accident of this case by the defendant and his defense counsel occurred due to unforeseeable crossing of the victim's unforeseeable without permission, and when considering the time required for the defendant to become aware of the victim and the movement distance of the bus, the defendant could not avoid collision with the victim, so there was no negligence on the part of the defendant.
