A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2012 Highest 11669"

1. On October 17, 2012, at the PC room where the Defendant’s trade name in Gyeyang-gu Incheon Gyeyang-gu was unknown, the Defendant discovered a false statement that “the victim E purchases a Hphone on the Internet “F” website, and contacted the victim with the victim, thereby selling the Hphone at KRW 300,000,000, including the Hphone.”

2. On October 21, 2012, the Defendant found out any writing on the part of the victim G to purchase other via a vial, ample, ample, etc. on the Internet “F” website at the PC room where the trade name in Gyeyang-gu Incheon, Gyeyang-gu, Incheon is unknown, and concluded that “other vial, ample, ample, and 100,000 won will be sold.”

However, the defendant did not have any other vial, ampample, or ample, and the defendant thought to use the money for personal purposes from the victim, so the victim did not have any intention or ability to sell the other ample.

The Defendant, as above, by deceiving the victim, received KRW 100,000 from the victim to the corporate bank account under the name of the Defendant on the same day under the name of the Defendant.

3. On October 23, 2012, the Defendant found out the writing that the victim H purchased wheelchairs on the Internet “F” website at the PC room where the trade name in the Gyeyang-gu Incheon Gyeyang-gu, Incheon would not be known, and made a false statement on the victim’s contact with the victim, thereby selling wheelchairs in KRW 360,000.

However, the defendant has no wheelchairs.
