1. The Defendant’s KRW 25,283,247 as well as 5% per annum from August 8, 2015 to March 3, 2016 to the Plaintiff.

The Defendant dumped wastes in the forest land within the Han River basin, which is managed by the Plaintiff, and the Plaintiff was responsible for the collection, transportation, and disposal of the wastes to another company as shown in the attached Form, and paid the expenses (i.e., collection cost of KRW 13,623,59, and KRW 11,659,648). On July 31, 2015, the Plaintiff asserted that he requested the Defendant to pay the above waste disposal cost by August 8, 2015, and filed a claim for the payment of the disposal cost. Therefore, the Defendant is liable to pay the above disposal cost and the delay damages to the Plaintiff.

As to this, the Defendant asserts to the effect that it is difficult for the Defendant to accept the Plaintiff’s claim due to its lack of self-sufficiency while recognizing all of the Plaintiff’s claims. However, such insolvent defense is not a legal assertion that can oppose the Plaintiff’s claim, and thus
